Even after you have purchased a auto you have the right to Reject or Revoke your auto under state UCC laws. TARR -The Uniform Commercial Code law or UCC has been enacted in all 50 states. TARR refers to Tender, Acceptance, Rejection, Revocation and TARR applies to the consumer's acceptance of purchased goods such as lemon autos.
TENDER-The tender portion of Kentucky's state law Section 2-601 provides that lemon auto buyers are entitled to reject lemon autos under state law that fail to conform to the contract. But Lemon autos are so technically complex that most car buyers are unable to find out if autos are defective or non-conforming at the time of purchasing cars. There is a technical state law difference between accepting rejecting and revoking.
ACCEPTANCE - Under state lemon law code the new auto buyer accepts his automobile he is reasonably believing and expecting that the auto manufacturer will repair or correct any problem he has with a lemon auto under the warranty. He accepts the contract based on all the implied and direct warranties the auto has.
REJECTION- Under Kentucky's Code and Federal Code If a new auto buyer discovers a defect in the auto within a reasonable time of inspecting the vehicle, he may reject a defective lemon auto. However, how long can he take to reject the auto?? The buyer must be given a reasonable time to inspect the automobile, but if he takes too long it may mean he has accepted the Lemon Auto. In deciding what is a reasonable time to inspect a lemon auto the Courts will look at the knowledge and experience of the auto buyer, the difficulty in discovering the defect in the lemon auto, and the opportunity to discover the defect. In Kentucky this is a very short time generally within hours or days after picking up the vehicle. REVOCATION- After you have has the lemon auto for a lengthy period of time you can still revoke your contract! The UC Code provides that a buyer may revoke his acceptance of goods or a lemon auto when the non-conformity substantially impairs the value of the goods to him because the defect was difficult to discover or if he was assured that non-conformities would be repaired. Of course, the average new auto buyer rarely discovers defective lemon auto problems until hundreds or thousands of miles later. Many Used Autos still carry some warranties. There may be the remainder of a new auto power train warranty and safety equipment or environmental warranties.
